1. Acceptance of Terms

By accessing or using TMarky (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

TMarky, a product of ABSRT LLC, is a free, informational tool that helps users organize the information a trademark attorney typically asks for. The Service offers a structured in-browser Wizard and an optional AI Chat mode. TMarky produces an intake summary intended to accelerate a conversation with a licensed attorney. TMarky is not a law firm, a trademark filing service, a trademark search service, or a legal advisory service of any kind.

3. Eligibility

You must be at least 16 years old to use TMarky. By using the Service, you represent and warrant that you meet this age requirement. No account registration is required.

4. Results Are Informational Only

Important: TMarky's intake summaries, checklists, and any Chat suggestions are for organizational and educational purposes only.

Trademark registrability, clearance, class selection, specimen sufficiency, and priority depend on facts, jurisdiction, and legal judgment that a short intake cannot capture. We strongly encourage you to:

  • Consult a licensed trademark attorney before filing anything
  • Commission a full clearance search where appropriate
  • Verify all names, dates, goods/services, and specimens with counsel
  • Not rely on TMarky for deadlines, filing decisions, or legal opinions

TMarky is not liable for any decisions made based on its output.

5. No Attorney–Client Relationship

Using TMarky does not create an attorney–client relationship between you and ABSRT LLC or anyone associated with it. Communications with the Service, including the optional Chat, are not privileged. Do not send anything you consider confidential legal correspondence.

6. Your Content and Responsibility

The information you enter into TMarky — including anything you type into the Wizard, any personal details, and any messages you send through Chat — is your own. You are responsible for its accuracy, for the rights to submit it, and for how you use the summary TMarky generates. Every identifying field in the Wizard is optional; leave any of them blank and the printed summary renders a fill-in line in the same place.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations
  • Scrape, crawl, or otherwise harvest data from the Service using automated tools
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service to transmit malware, viruses, or harmful code
  • Submit another person's personal information, confidential business information, or privileged legal correspondence through the optional Chat feature

8. Intellectual Property

All content on TMarky — including the Wizard structure, intake questions, checklists, attorney-notes logic, UI design, the TMarky name, and the TMarky logo — is owned by ABSRT LLC and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of the information you enter about your own brand. You may not reproduce, distribute, or create derivative works from TMarky content without the express written permission of ABSRT LLC.

9. Privacy

Your use of TMarky is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Service, you consent to the data practices described there.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, completeness, or suitability of any intake output for any particular purpose, and specifically make no warranty that it is sufficient for filing with the USPTO or any other trademark office.

11. Limitation of Liability

To the fullest extent permitted by applicable law, ABSRT LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed $0, as the Service is provided free of charge.

12. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We also reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of the United States.
