Privacy Policy

1. Who We Are

TMarky is a product of ABSRT LLC ("we," "us," or "our"), a free tool that helps you organize the information a trademark attorney typically asks for. We are not a law firm, a trademark filing service, or a legal advisor, and we do not facilitate the registration of any mark. 2. What Information We Collect

We are committed to collecting as little information as possible. Here is what we collect and why:

Wizard Answers (on your device only)

The Wizard runs entirely in your browser. Your answers are saved to your browser's local storage so you can resume your intake and generate your printed summary. They are never uploaded to us, never linked to any identity, and never shared. You can clear them at any time with "Start over" on the Results page or by clearing your site data.

Personal Fields (optional by design)

Every identifying field in TMarky — owner name, business name, mailing address, contact name, email, and phone — is optional. Leave any of them blank and your printed summary renders a fill-in line in the same spot. The Results page also has a "Print without personal info" toggle that strips these fields from the printed copy even if you did fill some in.

Consent Record (on your device only)

When you make a choice in our cookie banner or preference center, we store that choice in your browser's local storage so we can honor it and prove that you were asked. This record contains no personal data and is never transmitted to our servers.

AI Chat Input (only if you enable Chat)

If you opt in to the AI Chat feature, the messages you type are transmitted to our AI processing provider to generate a response. This text is used only to produce your response, is not stored on our servers, and is not linked to any identity by us. Please be mindful not to include sensitive personal or confidential information in your messages.

Server Request Logs

Our hosting provider may collect server-level access logs (IP address, user-agent, request path, timestamp) as part of normal infrastructure operation, for security, abuse prevention, and reliability. These are typically retained for a short period at the provider.

3. What We Do Not Collect

• No user accounts, passwords, or login credentials
• No server-side storage of your Wizard answers or printed summary
• No location data or device identifiers (IDFA, GAID, or similar)
• No browsing history outside of TMarky
• No payment information (TMarky is free)
• No sale or sharing of personal information for advertising

4. Cookies, Local Storage & Consent

TMarky does not use advertising cookies or tracking pixels. We manage a small number of categories, each of which you can control via the cookie preferences panel in the footer or the banner shown on your first visit. Full details are in our Cookie Policy.

We use a very small number of third-party services to deliver TMarky:

Hosting

TMarky is hosted on our infrastructure provider, which processes IP addresses and standard request metadata to serve the site (see Section 2, Server Request Logs).

Fonts

Fonts are self-hosted from our own domain. We do not call Google Fonts or any other third-party font CDN, so no font-related requests leave our infrastructure.

AI Processing (only if you enable Chat)

When you use the optional AI Chat, your messages are sent to our AI processing provider to return a response. Your text is processed solely to return that response and is subject to the provider's privacy policy. We do not send any other personal information alongside your messages. The provider name and any international-transfer safeguard (Standard Contractual Clauses or the EU–US Data Privacy Framework) will be named here once Chat is generally available; until then, Chat is a stub and no messages are sent.

6. How We Use Your Information

The very limited information we handle is used exclusively to:

• Run the Wizard and produce your printed summary in your browser
• Remember your consent choices
• Return responses if you enable AI Chat
• Maintain security, prevent abuse, and keep the Service reliable

We do not use your data for advertising, profiling, or any other purpose.

7. Data Sharing

We do not sell, rent, share, or trade personal information for cross-context behavioral advertising or any other purpose. The only data visible to third parties is what necessarily passes through our hosting provider as part of serving the site, and — if you enable Chat — what you type into Chat, which is sent to our AI provider to generate a response.

8. Data Retention

Because your Wizard answers and consent record live only in your browser, you control their retention entirely — use "Start over" on the Results page or clear your site data to remove them. Server request logs are retained for a short period (typically ≤30 days) at our hosting provider for security and reliability. We do not retain AI Chat messages on our own servers beyond generating a response.

9. Your Rights

Depending on where you live, you may have the right to access, correct, delete, restrict or object to processing, and receive a portable copy of your personal data. Because TMarky stores your intake data only in your own browser, you can exercise most of these rights yourself — clear the site's storage or use "Start over" on the Results page. For anything else, email privacy@absrts.com. EU/UK users have the right to lodge a complaint with a supervisory authority.

California residents (CCPA/CPRA)

In the past 12 months TMarky has collected identifiers only if you enter them, plus basic server logs. We have not sold or shared personal information for cross-context behavioral advertising and do not do so. You have the right to know, delete, correct, and limit use of sensitive information. We honor the Global Privacy Control (GPC) browser signal — if your browser sends it, we automatically apply "reject all" for non-essential categories.

10. Children's Privacy

TMarky is not directed to children under 16 and we do not knowingly collect their personal information. If you believe a child has provided information through the Service, please contact us and we will take appropriate action.

11. Not Legal Advice

TMarky is an information-organizing tool. It provides no legal advice, creates no attorney–client relationship, and does not file or grant trademarks.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of TMarky after any changes constitutes acceptance of the updated policy.
